According to the consumers claimed that Powerbeats2 battery life and other features such as sweat and water resistance did not live up to Apple’s representations. Apple denies all acts of allegations, however, they have agreed to settle the class-action lawsuit in order to avoid the further risk and cost of ongoing litigation.

  • Claim Form Deadline: November 20, 2020
  • Who’s Eligible: Individuals who purchased Powerbeats2 earphones before Aug. 7, 2020. Settlement Class Members must have purchased the products for personal use, not for resale
  • Estimated Amount: Cash payments of up to $189
    • Exact payment amounts will depend on whether or not Class Members received a warranty repair or replacement and if they can provide proof of purchase
  • Proof of Purchase:Claim forms will require purchase information (dates, store name, city and state, etc.). Proof of purchase isn’t required but will allow for higher payments
  • Case Name & Number: Latanya Simmons, et al. v. Apple Inc., Case No. 17-CV-3 12251, in the Superior Court of the State of California for the County of Santa Clara
