To all persons who bought decking materials between Jan. 1, 2002 to Dec. 31, 2012, and/or railways from Jan. 2005 to Dec. 31, 2012, both that remained installed on the Class Member’s property on Nov. 11, 2016 made and sold by Building Materials Corporation of America and Elk Corporation, you are eligible for a potential award from the Cross Timbers, Duralife, Railways Class Action Lawsuit! According to the lawsuit, Building Materials Corporation of America and Elk Corporation had defective materials, with issues on the durability of the materials as well as the vulnerability to the growth of mildew, and mold. Building Material Corp maintains that their materials are not defective. They are compensating for the defective material by severity of the defection and amount of defective material in order to avoid the further risk and cost of ongoing litigation. So if you are eligible, file a claim by February 27, 2019 to receive your potential award!
