For individuals who paid overdraft fees on non-recurring Bank of America Debit Card transactions between Jan. 1, 2012 and April 6, 2017, you are eligible for a potential award from the Bank of America Overdraft Fees Class Action Lawsuit!

According to the lawsuit, Bank of America has a policy to not charge overdraft fees on non-recurring debit card charges, however some charges were wrongfully charged as recurring. So if you are eligible, check your mail for a letter with your Settlement payment, but if you would like to opt out, please fill out the form.

  • Claim Form Deadline: A Claim Form is not available on the settlement website. If you are a Class Member, you will automatically benefit from this settlement unless you opt out. The deadline to opt out is December 20, 2019
  • Who’s Eligible: Consumers who had an account with Bank of America and paid overdraft fees on debit card transactions classified as recurring charges between Jan. 1, 2012 and April 6, 2017 made with Lyft, Grubhub, Gett, Eatstreet, PicMonkey, Neighborfavor, AMI Entertainment Network, Seamless, Doordash, Postmates, or Eat24.
  • Estimated Amount: Estimated payments of $17.67 per overdraft fee. This amount is subject to change based on the number of eligible consumers and the net settlement fund after fees and expenses are deducted.
  • Proof of Purchase: Yes
  • Case Name & Number: Owens, et al. v. Bank of America NA, et al., Case No. 1:19-cv-20614-MGC, in the U.S. District Court for the Southern District of Florida

How To File a Claim

There is no claim form available, but if you are eligible, you will receive a letter in the mail with your settlement payment. If you would like to opt out of being in the settlement, fill out the form by December 20, 2019.
